If the Supreme Court rules for the funeral home, the commentators say, it’s because Justice Gorsuch and the court’s other textualists are acting politically. This fall, the U.S. Supreme Court takes up the case of R.G. Harris Funeral Homes Inc. v. Equal Employment Opportunity Commission, 590 U.S. ___ (2020), was a landmark United States Supreme Court case which ruled that Title VII of the Civil Rights Act of 1964 protects transgender people from employment discrimination. And that brings us to Harris Funeral Homes v. EEOC, SCOTUS’ first trans rights case.

Unfortunately, in 2018, the U.S. Court of Appeals for the Sixth Circuit reversed that decision , ruling against Harris Funeral Homes. That year, a male funeral director expressed the intent to begin dressing and presenting as a woman at work while interacting with grieving families. & G.R. And pray as well for all Americans. While the federal government now agrees with Rost, the ACLU insists that the Supreme Court should rewrite the law. We are called to do our very best and to follow God’s will, no matter the outcome, because God has a plan that we cannot begin to understand, a plan that is much bigger and better than anything we can imagine.Let’s continue to be faithful and true in our divine assignments, just as Harris Funeral Homes acted so courageously in pursuing this case.
The court is hearing three cases today and all of them are centered around interpreting Title VII, the part of the Civil Rights Act that prohibits employment discrimination on the basis of sex. The Supreme Court ruled against our client Harris Funeral Homes. So, this is the first transgender rights case to come before the Supreme Court, ever. It’s that it sets a legal frame for the case, too. How the court deals with the issue of misgendering plaintiffs in this context is going to send us a lot of signals about what the conservatives on the court, in particular, think about this area.We already have every reason to believe that they are going to be hostile to Stephens here, but also, how do the liberals on the court deal with this? But the ACLU intervened and continued to push for “sex” to be redefined to include “gender identity” in federal law.This case was combined with two others seeking to redefine “sex” to also include “sexual orientation.” The Court heard arguments in these combined cases on October 8, 2019.Unfortunately, the Supreme Court ruled that unelected officials and courts do have the authority to redefine the law—bypassing Congress—and that “sex” in Title VII includes “gender identity” and “sexual orientation.”This is devastating news for Harris Funeral Homes, which has faithfully served grieving families for more than 100 years. Not to mention that federal law allows such policies.Ultimately, Tom Rost—owner of Harris Funeral Homes—decided he could not agree to the funeral director’s plan, and they parted ways.That prompted the funeral director to file a complaint against Harris for employment discrimination, which led the Equal Employment Opportunity Commission (EEOC), an unelected federal agency, to sue the funeral home. So it’s up to the Supreme Court, which is hearing both cases together, to now set the official precedent for how Title VII will be interpreted when it comes to sexual orientation.First of all, everyone should care about this case–I mean, obviously, because trans rights are human rights, but also because this could have farther reaching implications beyond just the trans community.
